| | Not Sure What To Do About Father's Deathfuneral Etc I am 26 years old and just found out yesterday thats my Dad WAS Killed in a car accident. He Died in Arkansas, goal he lives in Oklahoma. I live in Kansas. The Truth Is That in my 26 years I Have only seen him / her a few "times. He Lived with us Until I Was 3, Then I saw HIM again at 5, And Then not again Until 23, And Then one last time at 25. I really do not Even Know His family did all. I Have Been Here in KS with My mom My Whole Life. His former wife has-been calling me telling me It Is up to Me to Decide What To Do With him (buried or cremated) then I Have to make funeral arrangements. He Owns Which Will Be Divided property Between Me And My Younger Brother and sister half. I feel very uncomfortable about all of this and feel it isn't fair sincere I really didn't Even Know HIM well at all. There Is No Way I Can go down to Arkansas to sign a paper to Cremate Saying HIM and I do not want To Have Them fax it to my work Either. His ex wife wants me to Talk to the funeral home and ask 'em if I Can Just Have Her Sign the paper. Does It Have to Be really all up to me I really WAS sincere Hardly a part of His Life? CommentsIda Mayhall says... As a child of the decedent with no spouse, you and your siblings are the legal next-of-kin. That does NOT mean that you HAVE to take charge of his funeral arrangements, you can release / relinquish these rights if you do not wish to be involved. Most likely you would need to sign documents stating that you give up your rights to any and all funeral arrangements. This document would only pertain to funeral arrangements, nothing more. The ex-wife may sign the papers, but only after the legal next-of-kin(s) either agree to a form of disposition (without you if you choose to release your rights) or they, too, decide not to be involved.
The other option is that you can sign only the document allowing him to be cremated, but without signing other documents that would make you financially responsible.
